CLASS ACTION AGAINST UBER CANADA INC. ET AL.

On September 28, 2021, the Superior Court of Quebec authorised a class action on behalf of Mr. Pierre-Olivier Fortier against Uber Canada Inc. et al. in response to the events that occurred in October 2016 when personal information provided by users and drivers of Uber Canada Inc. et al., collected, held, retained and used by Uber Canada Inc. et al., was communicated and/or made accessible in an unauthorised fashion to a third party.

On May 10, 2022, the Superior Court of Quebec ordered the publication of the Notice to members of the class action lawsuit. If you wish to consult the Notice, please click here for the detailed version, and here for the abridged version.

Please note that if you fall within the definition of the Class as described in the Judgment authorizing the class action, you are automatically part of the class action. You do not have to register.

If you have already filed an originating application concerning the same object as the class action, you are deemed excluded from the Class if the application is not discontinued by June 29, 2022, 4:30 pm.

If you have not already instituted an originating application concerning the same object as the class action, you can be excluded from the Class by informing in writing the office of the Superior Court in the district of Montreal of same by registered or certified mail. Your request for exclusion must be filed no later than June 29, 2022, 4:30 pm.

Notices to members were originally sent on May 30, 2022. These members had 30 days to opt out and the time limt to do so has now expired. Additional notices to certain members have been sent by Uber Canada Inc. with the Superior Court’s approval on August 23, 2022. If you received a notice on such date, your request to be excluded must be filed no later than September 22, 2022, 4:30 pm.

The class action follows the hacking of Uber in October 2016. The Plaintiff alleges that on this occasion, personal information of the Class members (i.e. information collected, held, stored and used by Uber) was made accessible to two hackers, through cloud provider’s servers which were used by Uber to hold and retain this information.

The allegations brought by the plaintiff against Uber and for which damages are claimed concern breaches in the protection of Class members’ personal information, including the unauthorized use of a cloud provider’s servers to hold and store the information, and the intentional concealment of the information hacking for over a year.
